What licenses do I need to open bars and terraces?
With the arrival of good weather, we all want to sit on a "terrace" for a Drink. But as in any business, there are a series of legal obligations regarding licenses.
- Apply for the license in question.
- Pay the fees.
- Once the license is granted, the works, facilities of the activity or operation of the business begin
Types of licenses to apply for at the Town Hall
The basic licenses are as follows:
- Works license: It will only be necessary in the event that works are to be carried out on the premises.
- Town planning compatibility certificate.
- Classified activity license: Required for annoying, unhealthy, harmful and dangerous activities, in accordance with the Law.
- Opening or operating license: Its purpose is to verify that the works and installations have been made in accordance with the building and activity licenses.
- First occupation license: Its objective is to verify that the work has been carried out in accordance with the project and the conditions established in the works license.
The license is non-transferable, that is, in the event that the business changes ownership, a change of ownership must be requested from the City Council.
To obtain these licenses, you can ask us for the following documentation:
- Project or Technical Report, it must be written by a technician and describes the installation and the activity to be carried out.
- Certificate of competent technician, which shows that the facilities of the establishment have been carried out under his direction, in accordance with the law and applicable regulations.
- Plan of periodic reviews by the competent entity designated by the owner, for fire protection equipment, adjusted to the regulations.
- Emergency plan according to self-protection regulations.
- Insurance policy, covering the risks of fire in the premises or facility, and civil liability for damages to attendees and third parties arising from the conditions of the premises, facilities and services, as well as the activity carried out and the personnel who provide their services in the same.
- Technical sheet of the premises or establishment.
Authorization for food handling and sale of meals prepared for consumption in the establishment.
And to open a terrace?
In addition to all the above documents, to mount a terrace, a specific license is required for it , therefore we will have to carry out the following procedures:
Request your opening permit from the corresponding City Council, filling in the corresponding form and paying the fee.
Attach the opening license of our premises.
The City Council technician will carry out an inspection prior to the approval or denial of the license.
It should be borne in mind that if the terrace is on public land, a price will have to be paid for its use, which will depend on the municipality, the time we request to open the terrace and the number of tables and chairs that we are going to place.
Finally, we leave you some links of interest; but remember that you have to consult with the City Council of the municipality where you intend to open your business and get bar license.
